Rite Aid is facing a legal battle to protect its business’s financial disclosure, a move that has sent its board of directors to revoke the company’s approval from the Food and Drug Administration (FDA) on Tuesday and to suspend operations for two months.
The board’s decision comes on the heels of an FDA advisory panel hearing on erectile dysfunction drug Viagra that sparked a lawsuit against the company over the drug’s use for sexual enhancement.
The hearing, which is scheduled to begin at the National Center for Law & Public Policy, addressed the issue of whether the FDA may require drug manufacturers to disclose financial relationships they hold, which are linked to the use of Viagra.
“FDA does not impose any duty to disclose known financial relationships,” said Dr. Brian D. Leuchter, a spokesman for the FDA.
“It is important that men with erectile dysfunction and those affected by this condition have access to effective treatments to help achieve their sexual goals,” he said.
The FDA has said the company must disclose financial relationships it holds, but did not require the company to disclose those relationships.
Viagra, which Pfizer acquired in 2013 from Merck under a deal worth more than $1 billion, was approved in November 2003 for the treatment of erectile dysfunction.
